What Does the Law Require?

Starting January 1, 2025, specified grocery stores and restaurants must have an AED in a prominent, accessible location for employees and customers. The device must be properly maintained to ensure functionality in case of emergency.

Who does this law apply to?

  • Restaurants: Restaurants that have fewer than 100 seats or an annual gross income of $1 million or less (not including off-premises sales) are exempt.

  • Grocery Stores: If your business has at least one major food department and at least 12,000 square feet of floor space, or if it has all major food departments (produce, meat, fish, dairy, and packaged products), you must comply. Retailers who make less than $10 million in gross annual income are exempt.

Tax Benefits for AED Purchases

Purchases of AEDs by businesses may qualify for tax deductions as regular operating expenses. A nonrefundable tax credit of up to $500 is also available to some Maryland restaurants for AED purchases. For more information, see your tax counselor.
